The
practice of so-called "honour killing" is in reality an act of murder.
It is usually carried out against a female family member who is seen by
relatives as dishonoring their family through real or perceived acts of
indiscretion, such as premarital sexual relations or unapproved dating.
In many cases of "honour killing", the accused woman is innocent, and is
killed purely based on suspicion. In other cases, the issue of "honour"
is used as a cover to justify a murder that was really committed for
other purposes. No matter what the reason is, "honour killing" is a
despicable crime.
There
is absolutely no justification in Islam for "honour killing" of women
or men. Those who commit these crimes can expect hellfire as their
punishment, in addition to the wrath and anger of God, as the previous
verse from the holy Quran describes. These types of killings are quite
simply murder crimes, and should be prosecuted as such. No society,
Muslim or otherwise, should tolerate such extrajudicial murder. This is
especially true if these murders are carried out in the name of Islam or
any other religion. There is no justification or leniency in Islamic
teachings for such murder crimes. Those who commit these crimes are
either ignorant of Islamic teachings, or they try to invoke religion to
get lenient treatment. In both cases, they must be punished as murderers
in order to establish justice and in order to act as a deterrent to
those who would consider committing such crimes.
There
is no historical background in Islam for "honour killing". No verse in
the holy Quran and no saying of Prophet Mohammad (pbuh) sanctions such
crimes. There were no cases of "honour killing" during the early period
of Islam. This is a concept that seems to have appeared only recently,
and is based only upon ignorance of the true teachings of Islam, and
perhaps some ancient customs that pre-date Islam.
Before
beginning, it is important to illustrate to the reader that honor
killings are not allowed in Islam. The best way to highlight this is by
searching Islamic Law to find any requirement for honor killings
Background:
An honour killing is when a family member is murdered by one or more
fellow family members, when they believe the victim to have brought
dishonour upon the family. The victims are usually female but can also
be male.
The Quran has a very high regard for a person's life and only accepts the taking of a life in very limited circumstances:
It
is because of this that We have decreed for the Children of Israel:
“Anyone who kills a person who has not committed murder, or who has not
committed corruption in the land; then it is as if he has killed all of
mankind! And whoever spares a life, then it is as if he has given life
to all the people.”... [5:32]
...and do not kill the soul which God has forbidden, except in justice... [6:151]
And
whoever kills a believer intentionally, then his reward shall be Hell,
eternally abiding therein, and God will be angry with him, and curse
him, and for him is prepared a great retribution. [4:93]
It
should be noted that nowhere in The Quran is a person allowed to take
the law into their own hands and act as judge, jury and executioner.
"Justice" here refers to a court of law. Also, the only acts punishable
by death in The Quran are for murder and causing corruption in the land
(i.e. done on a large scale), as shown above.
Sometimes
an honour killing is carried out due to sex out with marriage, but the
punishment for this in The Quran is not death [see 24:2].
The recurring theme of equivalence in The Quran must be taken into account when deciding upon the punishment for any crime:
And
those who, when gross injustice befalls them, they seek justice. The
recompense for a crime shall be its equivalence, but whoever forgives
and makes right, then his reward is upon God. He does not like the
wrongdoers. [42:39-40]
Thus,
the equivalent punishment for having one's honour or family honour
compromised can never be murder.(misconceptions about islam )
First of all, there is no such thing as “honor killing” in Islam. When it comes to Islamic Shari’a, the one who kills his wife or daughter is murderer and has to be punished by the Caliph, Judge or whoever is in charge of applying Islamic jurisprudence.
Secondly, this thing does not happen only in some Muslim countries so..
The United Nations Population Fund (UNFPA) estimates that the annual worldwide number of honour killings is as high as 5,000 women and girls, though some non-governmental organizations (NGOs) estimate as many as 20,000 honour killings annually worldwide. Despite limited statistics, research shows that honour killings occur amongst women of different ages, religions, and social status, wealth, education, and location.
Abu Huraira (Allah be pleased with him) reported that Sa'd b. 'Ubada al-Ansari said: Messenger of Allah, tell me if a man finds his wife with another person, should he kill him? Allah's Messenger ( صلی اللہ علیہ وسلم ) said: No. Sa'd said: Why not? I swear by Him Who has honored you with the Truth. There upon Allah's Messenger ( صلی اللہ علیہ وسلم ) said: Listen to what your chief says (i.e., he is saying something that is counter to Allah and His messenger’s orders). (Muslim 3761)
Abu Huraira (Allah be pleased with him) reported that Sa'd b. Ubada (Allah be pleased with him) said: Messenger of Allah, if I were to find with my wife a man, should I wait until I bring four witnesses? He said: Yes. (Muslim 3762)
