slave girls/ women -rape? claim

 Rape is an abhorrent crime and an abominable sin. This heinous crime is forbidden not only in Islam but in all religions, and all people of sound thinking and pure human nature reject it.

islam closes the door to the criminal who wants to commit this crime. Western studies have shown that most rapists are already criminals who commit their crimes under the influence of alcohol and drugs, and they take advantage of the fact that their victims are walking alone in isolated places or staying in the house alone. These studies also show that what the criminals watch on the media and the semi-naked styles of dress in which women go out also lead to the commission of this reprehensible crime.
The laws of Islam came to protect women’s honor and modesty. Islam forbids women to wear clothes that are not modest. In addition, Islam encourages young men and women to marry early, and many other rulings that close the door before rape and other crimes. Hence it comes as no surprise when we hear or read that most of these crimes occur in permissive societies, which are looked up to by some Muslims as examples of civilization and refinement! It is worth mentioning here that in America , for example, Amnesty International stated in a 2004 report entitled “Stop Violence Against Women” that every 90 seconds a woman was raped during that year
 The right to have sex with a woman does not necessarily imply that one has the right to rape her as well. To say that a Muslim man has the right to rape his slave girl is like saying that a man has the right to rape his wife; which is not true
 If the Prophet (peace be upon him) forbade slapping and whipping slaves then it's unthinkable that he would have permitted raping them. It just makes no sense.

Zadhan Abl Umar reported: I came to Ibn 'Umar as he had granted freedom to a slave. He (the narrator further) said: He took hold of a wood or something like it from the earth and said: It (freedom of a slave) has not the reward evert equal to it, but the fact that I heard Allah's Messenger (way peace be upon him) say: He who slaps his slave or beats him, the expiation for it is that he should set him free.

 Hilal b. Yasaf reported that a person got angry and slapped his slave-girl. Thereupon Suwaid b. Muqarrin said to him: You could find no other part (to slap) but the prominent part of her face. See I was one of the seven sons of Muqarrin, and we had but only one slave-girl. The youngest of us slapped her, and Allah's Messenger (may peace be upon him) commanded us to set her free.

 And let those who do not find the means to marry keep chaste until Allah makes them free from want out of His grace. And (as for) those who ask for a writing from among those whom your right hands possess, give them the writing if you know any good in them, and give them of the wealth of Allah which He has given you; and do not compel your slave girls to prostitution, when they desire to keep chaste, in order to seek the frail good of this world's life; and whoever compels them, then surely after their compulsion Allah is Forgiving, Merciful. (The Noble Quran, 24:33)"
 we clearly see that if the slave woman desires to keep chaste, then her Muslim master must not compel her into sex. 

This verse was revealed after the following incident:
Narrated Jabir ibn Abdullah:  “Musaykah, a slave-girl of some Ansari, came and said: My master forces me to commit fornication. Thereupon the following verse was revealed: “But force not your maids to prostitution (when they desire chastity). (24:33)”  (Translation of Sunan Abu Dawud, Divorce (Kitab Al-Talaq), Book 12, Number 2304)”
So here we have a direct and explicit refutation to the precise argument of the critic. A man was forcing his slave girl into fornication, and so the Quran revealed a verse that said that you are not allowed to force slave girls, i.e. right hand captives, into fornication.
Hence the Quran completely refutes the argument of Muslims supposedly being allowed to rape or force their right hand captives into sex, this is a figment of the critics own warped imagination. BY 

 In Islam, men are not allowed to rape their slave-girls. Allah Almighty clearly prohibited it in Noble Verse 24:33

Islam encourages the freeing of slaves and their joining in marriage as a means to improve their status in society. Concubinage was a form of marriage in Islam that was abolished when Muslim countries ended slavery. Islam forbids rape and prostitution in all cases as they are major sins in the category of adultery.
Most ancient societies allowed a form a concubinage in which a master would be intimate with his female slaves. According to the Bible, Solomon had seven hundred wives and three hundred concubines (1 Kings 11:3). Concubinage (as-sirr) in Islam was a marriage (nikah) between a free man and his female slave
 this is unlike the concubinage of societies that treated such women as property without rights. Rather, Islam made the concubines like wives with similar rights to maintenance and good treatment. A man would not be allowed to share his concubine with other men, nor was he allowed to be intimate with another man’s concubine. In this respect, the Quran commands Muslims to marry (ankihu) their female slaves in the same way free women are married.
 In conclusion, the only lawful sexual relations in Islam are those in a valid marriage between a man and a woman. Concubinage as a form of marriage has become obsolete with the abolition of slavery. Furthermore, it is not lawful for a Muslim to commit rape or prostitution under any circumstances.

  West’s moral dilemma!
 Keeping slave girls for sexual use (i.e. concubines) was the prevailing practice for centuries before Islam. What Islam did, in fact, was establish the status of a concubine to be more or less equal to that of a wife. That's for one. You can see this in the Qur'an, where all verses about marriage talk about both wives and "that which your right hand has", a more thoughtful and politically-correct term for concubine. Wives and "that which your right hand has" always go together as two "types" of marriages, for lack of a better word.

In a broader sense, Islam promoted the status of a slave in general to that of a worker. It set the (then revolutionary and, to the non-believers, almost bordering on the absurd) ground rules that gradually made it impossible for slavery to be possible or practical anymore. Naturally, it was not possible for a Muslim to kidnap people and force them into slavery. Moreover, slave owners were now required to feed slaves of the same food they eat, and dress them of the same dress. All sorts of punishment and physical torture of slaves were abolished. Islam also set clear ways for slaves to work their way out of slavery: the Qur'an instructs Muslim slave owners to free their slaves after a period of work and even give them monetary compensation (Quran 24:33), many heavenly rewards and redemption of many sins (particular and general) are promised for the act of freeing a slave.


 Firstly, the term ‘ma malakat aymanukum’ (Literally: What your right hands possesses) is not gender specific and as an idiomatic expression, applies to ‘those that one keeps in protection and honour’. This can include captives, slave girls, maidens, servants  (fatayatikum 4:25) etc. Please note that the ‘right hand’ has a somewhat glorified meaning in the Quran which is apparent from its usage in different contexts (e.g. those on the right hand in heaven; books of one’s deeds given to the right hand etc).

It is also apt to note that affluent women would have also most likely to have possessed men slaves. This is confirmed by the usage of the idiomatic expression 'ma malakat aymanuhunna' when used in reference to women's possession. It would be inconceivable to conclude on the basis of this expression, the permissibility of women to engage in ‘free sex’ with their male slaves or captives.

The following points must be noted with regards to 'those that your right hands possess' from the Quran.

(1)          Be good to them as you are with your parents, orphans, needy, neighbours and free them if you can
(2)          Do no compel them to whoredom or force them
(3)          You can only have sex with them through marriage / wedlock

(2) AND GIVE THEM THEIR RIGHT OF FREEDOM AND DO NOT COMPEL THEM TO WHOREDOM OR FORCE THEM

"Let those who find not the wherewithal for marriage keep themselves chaste, until God gives them means out of His grace. And if any of your slaves ask for a deed in writing, give them such a deed if you know any good in them and give them from the wealth of God which He has given you. But force not your slave girls (Arabic: fatayatikum) to prostitution when they desire chastity, in order that ye may make a gain in the goods of this life. But if anyone compels them, yet, after such compulsion, is God, Oft-Forgiving, Most Merciful (to them)"

Note: Those that cannot marry need to stay chaste, attempt to free those that their right hands possess and certainly not force them to sex or prostitution. However, if the poor unfortunate slave girls are forced, they will still find mercy from God, bounties which extend to all His creatures.

“If any of you have not the means wherewith to wed free believing women, they may wed believing girls from among those whom your right hands possess: And God has full knowledge about your faith. Ye are one from another: Wed them with the leave of their owners, and give them their dowers, according to what is reasonable: They should be chaste, not lustful, nor taking paramours: when they are taken in wedlock, if they fall into shame, their punishment is half that for free women. This (permission) is for those among you who fear sin; but it is better for you that ye practise self-restraint. And God is Oft-forgiving, Most Merciful.”

  • It was better if one practiced self restraint. But if one couldn't marry free believing women, then the directive was given to marry from what their right hands possessed. Not for prostitution, not for lust, but for wedlock.
  • Notice here that although one can ‘marry’ a woman from one's right hands possess, her status is not that of a ‘Free believing woman’ (as can be seen from the half punishment she can potentially exact for the same sin). This is the reason why women that form part of those whom your right hands possess are referred to as a separate category. However, they do not form an exception to the marital rule in terms of who is lawful for sex. See 23:6 & 70:30. In other words, they still have to be married.
  • One logical question bears asking keeping in view any appetite for carnal desires. If one has wives along with many hand maidens with whom one could potentially have free sex, then what kind of sexual predator and maniac does one have to be to still commit adultery? The Quran imparts a consistent message with regards abstention from any unrighteous lust. What is the purpose of having sex with captives if it is not for lust?

Scripture has never permitted men to engage in sex outside the institution of marriage whether this is from the category of free believing women, or from the category of 'right hands possess'.(Joseph Islam)

The main reference cited is Chapter 23:1-6 in the Quran. It reads:
“And successful are the believers who guard their chastity … except from their wives or those that their right hands possess.”

The reference is about sexual relations, which are forbidden with any woman unless she is a spouse or ‘those their right hands possess’. To be clear, this means a concubine, bondmaid or a slave, but intercourse has to be consensual. Rape is forbidden as it is violent, and Islamic texts legislated for the proper and honourable treatment of slaves.

Even consensual sexual relations with a slave were not permissible if it caused harm and abuse elsewhere (e.g. to a wife) as all parties involved would be affected.
Furthermore this is not an entitlement. Concubinage and interpersonal relations with various bondmaids/slaves was already occurring at the time the Quran came about and subsequent passages list restrictions as a starting point to help to bring about the end of slavery. In any case, marriage was encouraged (Chapter 24:32) with slaves.
In fact, slavery was never endorsed by Islamic texts; rather it was something inherited from pre-Islamic cultures (pre-600s) that needed to be voluntarily and gradually weeded out of society through manumission, which was highly encouraged (Chapters 24:32-33 & 16:71). Islamic texts list a plethora of avenues to free slaves, as it was seen as a highly virtuous act. It’s difficult to find any references on how to make slaves out of people; rather the focus is always on ending slavery.( by mariam hakim )

‘Others’ includes all people, so also slavegirls ! Raping a slavegirl is clearly doing her harm (emotional and physical) which would be a big sin for a muslim to commit and violation of the above hadith. Moreover the prophet  (peace be upon him) commanded muslims to treat their slaves well and with respect, which clearly proofs that rape of female slaves is forbidden in islam. The phrase  "What your right hands possess"  refers to one’s slaves (male and female). Allah swt ordains the kind treatment of slaves in the same verse where He commands man to worship Him and to treat his parents, relations and neighbours generously, and this signifies the importance of this ruling.

 In spite of this social fact, Islam was the first religion to recognize slavery as a social illness that needed to be addressed. Since slavery was deeply rooted in the society, Islam did not abolish it at once. Rather, Islam treated slavery in the same manner it treated other social illnesses. Islam followed the same methodology of gradual elimination in dealing with this social disease as it did with other social illnesses, for example: the prohibition of alcohol in three steps.

As for marrying slaves, it is something permissible under two conditions: first, if one is unable to pay the dowry of a free woman. Second, if there is fear of committing adultery if one doesn’t get married. This is clarified by the following verse: “And whose is not able to afford to marry free, believing women, let them marry from the believing maids whom your right hands possess. This is for him among you who feareth to commit sin. But to have patience would be better for you.” (An-Nisaa’: 25)

This verse shows that Muslim men should abstain from illicit relations and seek enjoyment through marriage to free women or through their female slaves.

In conclusion, Allah has forbidden certain types of behavior and permitted other kinds of behavior as a safeguard to the individual and to the society. Allah has forbidden fornication and adultery. However, in the case of captives whom your right hands posses, it's something necessitated by the special circumstances which were created when the Muslims were at war.”



 '' The point I am trying to make is that the idea of the possibility of slave girls willingly having sex with their captors is not absurd. Thus, one is required to provide proof that those slave girls who had sex with their Muslim captors did not consent. This is especially due to the fact that 1) It was possible for slave girls back in the past to consent to having sex with their captors and 2) Muslims were prohibited from harming their slave girls.

If the critic says that not all of the slave girls felt this way and there were bound to be some who didn't want to have sex, I would agree with him. However, how does this prove that the Muslims raped their slave girls? How does the critic know whether the Muslim back then actually raped the slave girl who was unwilling to have sex with him? Isn't it possible that if he saw her unwilling he would have sold to her to another Muslim at a cheaper price? Or he would have purchased another slave girl who was willing to have sex with him? Or he would have waited for her to consent, for by that time he would have treated her very nicely and convinced her that Islam is true and that it was her tribe's fault for starting the battle, etc. Yes these things are possible.'' CAPTIVES OF BANU AL MUSTALIQ: RAPED OR RELEASED**



FROM SAHIH ( ? )BUKHARI - VOLUME 9, #506:
Narrated Abu Said Al-Khudri that during the battle with Bani Al-Mustaliq they (Muslims) captured some females and intended to have sexual relations with them without impregnating them. So they asked the prophet about coitus interruptus. The prophet said( ? ), "It is better that you should not do it**, for Allah has written whom He is going to create till the Day of Resurrection".
Qaza'a said, "I heard Abu Said saying that the prophet said, "No soul is ordained to be created but Allah will create it.""

1-is this rumor-  hadith (? ) authentic ? ( we don't know )
2-according to rumor- hadith (? ) the prophet didn't approve it*
3-.  '' Why would the sahabah-companions  (radiyallahu anhum) worry about seeking permission for doing coitus interruptus if they intended to do a haraam act (al-iyaazu billah) and a major sin by committing rape? That would be just as silly as it would be for robbers to worry about getting formal permission to enter the house of the victim they intend robbing.''

5- ONE OF THE MOST IMPORTANT  POINT THAT IDDAH LAW IS HIGHLY SIGNIFICANT IN THIS RESPECT AS IT WILL AUTOMATICALLY AVOID THESE SITUATIONS
6- BUT THE GENEROSITY AND HUMANNESS OF SAHABA CAN BE EASILY WITNESSED IN THE HADITH FOLLOWED WERE THEY RELEASED ALL CAPTIVES.

‘Aa’ishah, may Allah be pleased with him, said, “The marriage of the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) to Juwayriyah, may Allah be pleased with her, was the cause of the setting free of one hundred families of the Banu Al-Mustaliq. I do not know of a woman who was greater in blessing to her people than she was. Following the incident, Al-Haarith bin Abi Dhiraar, Juwayriyah’s father, came to Madeenah with the ransom of his daughter. The Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) invited him to embrace Islam, and he did.”
 The Battle of Al-Muraysee‘ is considered one of the unique and blessed Battles in Islam. Following that Battle, a whole tribe embraced Islam. The reason behind their conversion to Islam was that the Companions, may Allah be pleased with him, freed and returned the captives that were their shares of the booties. They hated to enslave the relatives of the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ). Due to that communal emancipation and unique generosity, the whole tribe embraced Islam.
The far reaching cause of this historical event was the love that the Companions, may Allah be pleased with them, had for the Messenger of Allah sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) honoring him and exalting his great personality. As such, love of the Prophet sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) gives these fine fruits and produces such unique incidents in history.
There were far reaching aims behind the marriage of the Prophet sallallaahu `alayhi wa sallam ( may Allah exalt his mention ) to Juwayriyah bint Al-Haarith, may Allah be pleased with her, and these aims were achieved when her people embraced Islam. The conversion of her people to Islam was one of the goals behind that marriage. In this way the number of Muslims increased, and Islam became more exalted; thus the hopes behind that marriage were achieved. Allah The Exalted facilitated the marriage, blessed it and realized the goal behind it, as Juwayriyah, may Allah be pleased with her, as well as her father embraced Islam, and then the whole tribe embraced Islam as well. This marriage resulted in blessing and power for Muslims as well as the material and moral support altogether for Islam and the Muslims.
